Is Obama trying war criminals in civilian court because he doesn't believe in the war on terror? Why else?

Would he refuse to even use the term "war on terror" and instead name it something ridiculous like "overseas contingency operation"? Doesn't he know that we didn't declare war on them, they declared war on us?
